Acceptable Use Policy
This Acceptable Use Policy sets out what may and may not be done with the SoniqPay Platform. It is incorporated into our Terms of Service and any Service Agreement, and it applies to you, your users, and your sub-merchants.

01Scope
This Policy applies to all use of the Services. If you enable sub-merchants on the Platform, you are responsible for their compliance with this Policy and for enforcing it within your portfolio.
Payment card network rules, Provider requirements, and applicable law apply in addition to this Policy. Where they are stricter, they control.
02Prohibited businesses and activities
You may not use the Services in connection with:
- activity that is unlawful in any jurisdiction where the transaction occurs, or that facilitates unlawful activity;
- unlicensed gambling, wagering, or games of chance, or licensed activity offered outside the jurisdictions the license covers;
- transaction laundering, factoring, or processing transactions on behalf of an undisclosed party or a business other than the one underwritten;
- dealings with persons, entities, or jurisdictions subject to applicable sanctions or export controls;
- money laundering, terrorist financing, or evasion of currency controls or reporting requirements;
- child sexual abuse material, non-consensual intimate imagery, or any content that sexualizes minors;
- human trafficking, forced labor, or the sale of human organs;
- sale of illegal drugs, controlled substances, drug paraphernalia, or prescription medication without valid prescription;
- sale of weapons, ammunition, explosives, or components thereof where prohibited or unlicensed;
- counterfeit goods, stolen goods, or goods that infringe another party's intellectual property;
- pyramid schemes, Ponzi schemes, multi-level marketing structures with no genuine product, or "get rich quick" offerings;
- deceptive practices, including undisclosed negative-option billing, misleading claims, or fake reviews and endorsements; or
- any activity a Provider or card network has notified us is prohibited on your account.
03Restricted activities requiring prior approval
The following require our prior written approval and appropriate Provider arrangements before any live transaction is processed. Approval depends on your licensing, jurisdiction, and controls.
- licensed gaming, wagering, sports betting, and lotteries;
- sweepstakes, contests, and promotional games;
- fantasy sports and prediction markets;
- digital assets, cryptocurrency, and stablecoin flows;
- nutraceuticals, supplements, and CBD or hemp-derived products;
- adult content and services involving legal adult material;
- debt collection, credit repair, and high-cost lending;
- firearms and related accessories where lawful and licensed; and
- tobacco, vaping, and alcohol.
Counsel and your Providers should confirm this restricted list matches what each Provider will actually support.
04Prohibited technical conduct
You may not:
- probe, scan, or test the vulnerability of the Services except under our published responsible disclosure program;
- attempt to gain unauthorized access to any account, system, or data;
- submit test, fabricated, or artificially generated transactions to production systems;
- use the Services to send unsolicited communications or to distribute malware;
- scrape, harvest, or systematically extract data from the Services;
- exceed documented rate limits or circumvent usage controls; or
- misrepresent transaction data, including merchant descriptors, MCC codes, transaction amounts, or the identity of the merchant of record.
05Card data handling
You may not store full primary account numbers, full track data, card verification values, or PINs outside a PCI-compliant environment. You must use the tokenization mechanisms provided by the Platform for storing payment credentials, and must not attempt to reverse or export tokens except as expressly supported.
06Enforcement
We may investigate suspected violations and may suspend or terminate access, remove content, notify Providers or card networks, and report to law enforcement where appropriate. Where practicable and lawful, we will give notice and an opportunity to cure. Serious violations may result in immediate suspension without notice.

08Changes
We may update this Policy as legal requirements, Provider rules, and card network rules change. The current version is always posted here.
